LucidTrend Investment Club's User AgreementDISCLAIMER, TERMS, AND CONDITIONSAcumen Financial LLC, an Alabama corporation (referred to hereafter as 'AFL'), offers a premium subscription-based service known as LucidTrend Investment Club. which is an expanded suite of online tools, services and training materials beyond what is currently offered under the Free User status. By completing the registration process, paying all required subscription fees, and using LucidTrend Investment Club, you are indicating that you agree to be bound by all of the terms in this Subscriber Agreement. Please print and keep a copy of this Agreement. AFL may change the terms in this Subscriber Agreement with or without notice. If you do not agree to be bound by the changes, you should discontinue your use of LucidTrend Investment Club and cancel your subscription to LucidTrend Investment Club. PRIVACY OF INFORMATIONPlease review our PRIVACY STATEMENT, which also governs your use of LucidTrend Investment Club, to understand how we collect and use information about you. FEES, PAYMENTS, AND TERMINATIONTrial Membership to Full MembershipWhen you sign up for a 14-day free trial for LucidTrend Investment Club Membership, you don't need to provide us with a credit card information. We offer "try it before buy it"! You have 14 days to review LucidTrend Investment Club. If you decide to subscribe to our services, you have will make a payment to us by using our payment provider. Your credit card will be charged for the full LucidTrend Investment Club Membership rate that you select at time of signup. This membership rate will automatically renew each billing period (Monthly, Quarterly or Yearly). You can cancel your subscription at any time from your profile page. If you decide to cancel LucidTrend Investment Club during your full membership, your membership will be set to expire prior to the next billing period. You can continue to use our service up until the expiry date. There are no refunds of any kind. Only One Trial Per UserYou may only take one (1) trial membership within a one year period. You may become a LucidTrend Investment Club Member at any time by paying the full membership rate. To CancelYou must cancel your membership from My Profile page within LucidTrend Investment Club. You can access this page and cancel your membership at any time. There are no refunds given of any kind. COPYRIGHT AND LIMITATIONS ON USEOnly one individual may access LucidTrend Investment Club at the same time using the same user name or password unless agreed otherwise by AFL. The content available through LucidTrend Investment Club is the property of AFL or its licensors and is protected by copyright, trademark and other intellectual property laws. LucidTrend Investment Club is a trademark of AFL. Content received through LucidTrend Investment Club may be displayed, reformatted, and printed for your personal, non-commercial use only. You agree to access the information available on LucidTrend Investment Club manually by request and not programmatically by macro or other automated means. You agree not to reproduce, retransmit, distribute, display, disseminate, sell, publish, broadcast or circulate the content received through LucidTrend Investment Club to anyone, including but not limited to others in the same company or organization, without the express prior written consent of AFL, with this one exception: You may, on an occasional and irregular basis, disseminate an insubstantial portion of content from LucidTrend Investment Club for non-commercial purposes, without charge, to a limited number of individuals provided you include all copyright and other proprietary rights notices with such portion of the content in the same form in which the notices appear in LucidTrend Investment Club, original source attribution, and the phrase 'Used with permission from 'AFL' To request consent for other matters, please contact AFL at 334-268-9095. ACCESS, AVAILABILITY OF SERVICE, AND LINKSLucidTrend Investment Club may contain links to other related web sites and resources of LucidTrend Investment Club. Since AFL is not responsible for the availability of these outside resources, or their contents, you should direct any concerns regarding any external link to the site administrator or Webmaster of such site. AFL reserves the right to discontinue LucidTrend Investment Club's availability to you based on circumstances beyond our control. DISCLAIMER OF WARRANTIES AND LIABILITYPlease visit https://www.lucid-trend.com/Disclaimer.html INDEMNIFICATIONYou hereby indemnify, defend and hold harmless AFL and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the 'Indemnified Parties') from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you or any user of your LucidTrend Investment Club account of this Agreement or the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. AFL reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. REGISTRATION AND SECURITYAs part of the registration process, you will create a password and your email address is your user id. You are also required to give us certain registration information, all of which must be accurate and updated. You may not: (i) select or use a login credential of another person with the intent to impersonate that person; (ii) use a login credential in which another person has rights without such person's authorization; or (iii) use a login credential that AFL, in its sole discretion, deems offensive. Failure to comply with the foregoing shall constitute a breach of this Agreement, which may result in immediate termination of your account. You shall be responsible for maintaining the confidentiality of your password. You shall notify AFL (contact support) of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft or unauthorized disclosure of your password. If you believe someone has accessed LucidTrend Investment Club using your user name and password without your authorization, you must contact AFL Monday - Friday 9am - 5pm ET at 334 268 9095. You are responsible for all usage or activity on your LucidTrend Investment Club account, including the use of the LucidTrend Investment Club by any third party authorized by you to use your email address and password. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at AFL's sole discretion and AFL may refer you to appropriate law enforcement agencies. MISCELLANEOUSThis Agreement is personal to you, and you may not assign your rights or obligations to anyone. If any provision in this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. This Agreement, your rights and obligations, and all actions contemplated by this Agreement shall be governed by the laws of the State of Alabama. You consent to the exclusive jurisdiction and venue of courts in Pike County, Alabama, USA. AFL's TERMS OF USE are hereby incorporated as part of this Subscription Agreement. By agreeing to the terms of this Agreement, you also are agreeing to abide by, and be bound by, AFL's Terms of Use. |
